"2.
As a condition of this appropriation, the Departments of Medical Assistance Services and Mental Health, Mental Retardation and Substance Abuse Services (DMHMRSAS), in cooperation with the Mental Retardation Waiver Task Force and other interested parties as the Task Force may see fit to include, shall develop and define the array of services with provider qualifications, eligibility, and the units of service for any revisions to the home- and community-based waiver for mental retardation services.  Consideration shall be given to the key values of the consumer and the family in their choice of services and providers; providing flexibility to best meet the needs of the consumer; protecting the health, safety and well-being of the consumers; and providing supports that are self-directed when possible.  These values shall be incorporated into the draft revisions to the waiver.  Consideration shall also be given to the handling of emergencies, managing the waiting list, and processing new enrollments or service modifications.  Revisions to the waiver shall incorporate relevant elements of the plan developed by DMHMRSAS, pursuant to item 323, paragraph J, of this act concerning care coordination, case management and service delivery.
3. The revised home- and community-based waiver for mental retardation services shall be drafted and shall be submitted to the House Appropriations and Senate Finance Committees along with an implementation plan to include strategies for provider development, rate-setting methodologies, impact of major systems changes and transition from the current waiver to the revised waiver.  The revised waiver and implementation plan shall be submitted by November 15, 2001."


Explanation
(This amendment requires the Department of Medical Assistance Services and DMHMRSAS to revise the mental retardation waiver in cooperation with the current Mental Retardation Waiver Task Force and other interested parties and to present the draft waiver and an implementation plan to the House Appropriations and Senate Finance Committees for review, prior to implementation.)
