"to contract for out-of-state beds and for beds in Virginia local and regional jails, and $7,269,862 the second year, including $2,869,862 for the capital lease payment and $4,400,000 for operating expenses".

Page 297, following line 56, insert:
"c. It is the intent of the General Assembly that the Department of Corrections return all Virginia state inmates from the Newton County, Texas, Detention Center to Virginia, not later than June 30, 1997. "

(This amendment expresses legislative intent that all Virginia state inmates housed in Texas be returned to state correctional facilities in Virginia by June 30, 1997, and eliminates $6,132,000 in general funds the second year that was appropriated for housing inmates in Texas. The Department of Corrections contract program with local and regional jails is expanded to house these inmates using excess space in local and regional jails, through a companion amendment to Item 78 which appropriates $6,132,000 for this purpose. This amendment also specifies that up to $4,400,000 is available for the operation of the new private prison in Brunswick County, opening on or after March 1, 1998, along with $2,869,862 for the capital lease payment. The remaining balance of $856,000 in Item 457 the second year is reverted to the general fund.)
