"c. It is the intent of the General Assembly that the Department of Corrections return all state responsible inmates from the Newton County, Texas, Detention Center to Virginia, not later than June 30, 1997, and that additional bedspace as necessary be made available in Virginia through jail contracts with Virginia local and regional jails, in order to provide sufficient bedspace in state correctional facilities in Virginia to effect this purpose.  Further, it is intended that all local and regional jails assist the Department of Corrections in identifying available beds.  Jail contracts with the Department of Corrections shall take priority over contracts for all other non-state offenders.  The Director, Department of Corrections, and the Executive Director, State Compensation Board shall jointly provide a report on the implementation of this Item to the Governor and the Chairmen of the Senate Finance and House Appropriations Committees not later than June 30, 1997."


Explanation
(This amendment expresses legislative intent that all Virginia state responsible inmates housed in Texas be returned to state correctional facilities in Virginia by June 30, 1997, and transfers $6,132,000 in general funds the second year for jail contracting, for up to 600 beds for up to twelve months beginning July 1, 1997, to the State Compensation Board in Item 78, thereby providing sufficient funds to effect this intent. This amendment also specifies that up to $4,400,000 is available to contract for the operation of the new private prison in Brunswick County, opening on or after March 1, 1998, along with $2,869,862 for the capital lease payment. The remaining balance of $856,000 in this Item is reverted to the general fund.)
