Page 254, after line 4, insert:
"D. To the extent permitted by federal law, the State Plan for the Temporary Assistance to Needy Families (formerly, the State Plan for Aid to Families with Dependent Children) shall provide that the eligibility for assistance of an alien who is a qualified alien (as defined in Section 431 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, Public Law No. 104-193)  shall be determined without regard to alienage."


Explanation
(The Personal Responsibility and Work Opportunity Reconciliation Act gives states the option to exclude most qualified aliens from eligibility for social services funded by federal block grants to states under Title XX of the Social Security Act. Currently in Virginia, such social services are available to optional qualified aliens, all of whom are lawfully residing in the United States, on the same basis as other Virginia residents. This amendment would prohibit Virginia from revising its policies to bar optional qualified aliens from eligibility for services under the social services block grant.)
