Notwithstanding § 40.1-49.4 D, Code of Virginia, and § 4-2.02 of this act, the Department of Labor and Industry may retain up to $116,000 in civil penalties assessed pursuant to § 40.1-49.4 as the required federal grant match for voluntary compliance programs.
