A. No funds appropriated for this program shall be used for enforcement personnel to enforce local ordinances.


B. Revenues of the fund appropriated in Items 379 and 380 of this act are limited to those received pursuant to Title 4, Code of Virginia, excepting taxes collected by the Alcoholic Beverage Control Board.


C. The Department of Alcoholic Beverage Control shall operate its tobacco law enforcement programs without diverting personnel or other resources or support away from any enforcement or regulatory activities or programs which were in place or in effect as of January 1, 1998, and which were dedicated to wholesale wine and beer licensee oversight.


D. By September 1 of each year, the Alcoholic Beverage Control Board shall report for the prior fiscal year the dollar amount of total wine liter tax collections in Virginia; the portion, expressed in dollars, of such tax collections attributable to the sale of Virginia wine in both ABC stores and in private stores; and, the percentage of total wine liter tax collections attributable to the sale of Virginia wine. Such report shall be submitted to the Chairmen of the House Appropriations and Senate Finance Committees and the Virginia Wine Board.
