Authority: Discretionary Inclusion.


A. The Director of the Department of Planning and Budget, in consultation with the Secretary of Education, shall make transfers from this appropriation in each year of the biennium to implement the Virginia Plan for Equal Opportunity in State-Supported Institutions of Higher Education.


B. Administration of the Pre-Collegiate Program, including financial information, shall be the responsibility of the State Council of Higher Education. It is the intent of the General Assembly that the Department of Education cooperate fully in the planning and implementation of the Pre-Collegiate Program. Administration of all other programs shall be the responsibility of the State Council of Higher Education in consultation with the institutions of higher education.


C. Transfers shall be made to the institutions of higher education and other state agencies as necessary, for the following purposes:

The Director of the Department of Planning and Budget, in consultation with the Secretary of Education, may make transfers for sums greater or lesser than those listed, not to exceed the aggregate total of $10,797,069 the second year of the biennium. Any such transfers shall be reported to the Chairman of the Commission on the Impact of Certain Federal Court Decisions on the Commonwealth's Institutions of Higher Education and the State Council of Higher Education at least 15 days prior to the effective date.


D. Any unexpended balances of this Item at the close of business on June 30, 2000, included in Numbers 11 through 18 above in individual agency appropriations shall not revert to the surplus of the general fund but shall be carried forward on the books of the State Comptroller and reappropriated in the first year. Further, any unexpended balances at the close of business on June 30, 2001, in the same appropriations shall be carried forward and reappropriated in the second year.
