“K. Included in the amounts for Preservation of Open-Space Lands is $35,000,000 the first year from the general fund to be transferred to the Virginia Outdoors Foundation (Title 10.1, Chapter 18, Code of Virginia) to be divided equally among the seven federally recognized Tribes located in the Commonwealth for land acquisitions. Such land acquisitions shall not be subject to open-space easements or conservation easements under Title 10.1 unless agreed to by the Tribe acquiring the property.”

Explanation

(This amendment provides an additional $23 million from the general fund in fiscal year 2023 to support the purchase of Tribal lands in the Commonwealth, bringing the total provided for this purpose to $35 million from the general fund the first year. The amendment further specifies that the funds be divided equally among the seven federally recognized Tribes in the Commonwealth, and stipulates that any such lands purchased not be subject to any open-space or conservation easements unless agreed to by the Tribe acquiring the property.)
