Explanation
(This amendment provides $3,461,000 and 32 positions the second year from nongeneral funds for combatting cigarette trafficking, pursuant to Senate Bill 1230, as recommended by the Crime Commission. Senate Bill 1230 also creates a new licensure process for the sale of tobacco at the wholesale and retail levels, and transfers the regulation of the distribution of cigarettes and other tobacco products from the Department of Taxation to the Department of Alcoholic Beverage Control. A companion amendment reduces the Department of Taxation budget by $361,000 GF to reflect the transfer of this responsibility to ABC. A second companion amendment to Item 3-1.01 in Part 3 of this Act reduces the transfer of nongeneral funds from ABC to the general fund by $361,000, which enables ABC to spend an equal amount of nongeneral funds on tobacco enforcement. This amount, $361,000 NGF, is included in this amendment. A third companion amendment to the Revenue Page reflects the reduction in the ABC transfer for operational efficiencies.
