"The State Comptroller shall transfer all net proceeds deposited into the general fund collected from the auctioning of NOx allocations in June 2004 or deposit an equivalent amount of general fund revenues to the Vehicle Emissions Inspection Program Fund, established pursuant to § 46.2-1182.2 of the Code of Virginia.  These funds shall be used to pay expenses related to air quality monitoring and evaluation in the Commonwealth and for measures to improve air quality in areas designated by the U.S. Environmental Protection Agency as nonattainment areas to include the retrofitting of diesel school buses to reduce vehicle emissions.  The fees may be used for matching grants."

Explanation
(This amendment provides $11.6 million NGF for DEQ's Vehicle Emissions Inspection Program Fund. The Fund is designed to improve air quality in areas designated by the federal government as nonattainment areas. The revenue source for the $11.6 million is the net proceeds derived from the auction of NOx allocations in June 2004. These proceeds were deposited to the credit of the general fund.)
