"VVV.  The Department shall amend the State Plan for Medical Assistance to increase the Medically Needy standard for aged, blind, and disabled individuals to 50 percent of the federal poverty level effective July 1, 2005.  The Department shall have the authority to enact emergency regulations under § 2.2-4011 of the Administrative Process Act to effect this provision."

Explanation
(This amendment provides funding from the general fund the second year to expand Medicaid eligibility for individuals with income that exceeds standard income levels but are allowed to "spenddown" their excess income to a lower income standard to receive Medicaid services. Under current law, individuals with income that exceed 80 percent of the federal poverty level for the aged, blind, and disabled, currently $7,448 each month for an individual, must spend down to a lower level of income -- approximately 37 percent of poverty.)
