"A.1.  Notwithstanding any other provision of law, $1,027,700,000 is appropriated in this item to implement the Transportation Initiative of 2005.  This amount shall be transferred in the amounts specified to the items below and shall be used for the purposes detailed below.
2.  Out of this appropriation, $127,000,000 the first year and $137,900,000 the second year from the general fund shall be deposited into the Commonwealth Transportation Investment Fund and utilized for transportation projects, which shall include highway and mass transit projects across the Commonwealth.  These funds shall be distributed as directed pursuant to the provisions included in House Bill 2771, 2005 General Assembly Session.
3.  Out of this appropriation, $132,600,000 from the general fund and $123,800,000 from the Commonwealth Transportation Fund in the first year shall be transferred to Item 488 of this act and deposited into the highway share of the Transportation Trust Fund to fully fund projects on the Interstate, primary, secondary and urban systems identified as complete but requiring a deficit payoff in the fiscal year 2005-2010 Six-Year Improvement Program.
4.  Out of this appropriation, the first $40,000,000 collected in the second year from the revenues generated by the provisions of House Bill 1563, 2005 General Assembly Session shall be deposited into the Transportation Partnership Opportunity Fund to support timely and cost-effective construction and acquisition of transportation facilities pursuant to the Public-Private Transportation Act of 1995, as amended, and design-build projects authorized pursuant to § 33.1-12(b), Code of Virginia.
5.  Out of this appropriation, all revenues collected in the second year from fees assessed pursuant to House Bill 1563, 2005 General Assembly Session after making the deposits set out in paragraph A.4. of this item shall be deposited into the Local Congestion Mitigation Incentive Fund.  This amount is estimated at $60,000,000 in the second year, which shall be distributed to local governments on a $1.00 for $1.00 matching basis as set out in House Bill 1563, 2005 General Assembly Session.
6.  Out of this appropriation, an additional $35,000,000 in the second year from the Commonwealth Transportation Fund shall be allocated to the Local Revenue Sharing Program established pursuant to House Bill 2033, 2005 General Assembly Session, to incentivize local participation in transportation improvements.  In conjunction with funding provided in Item 488 for revenue sharing, this provides $50,000,000 in the second year for this program.
7.  Out of this appropriation, $33,200,000 the second year from the Commonwealth Transportation Fund is provided to the Rail Enhancement Fund to improve freight and rail passenger service throughout the Commonwealth pursuant to the provisions of House Bill 2596, 2005 General Assembly Session.
8.  Out of this appropriation, $70,000,000 the first year from the general fund is provided for transit capital projects as follows:  $10,000,000 for a bus rapid transit system in Virginia Beach, $20,000,000 for passenger rail car purchases and for equipment and facilities to increase capacity and expand to Gainesville, and $40,000,000 for rail car purchases by the Washington Metropolitan Area Transit Authority.  
9.  Out of this appropriation, $268,200,000 the second year from the Commonwealth Transportation Fund shall be transferred and allocated in accordance with Item 469 of this act and Titles 33.1 and 58.1, Code of Virginia, to address the overall needs of transportation infrastructure."

Explanation
(This amendment eliminates the Governor's proposed transportation package and replaces it with the House package. In total, this provides an additional $1,028 million for transportation over the biennium. This represents an additional $204 million more than had been included in the introduced budget.)
