The Block Grants for Temporary Assistance for Needy Families Public Law 104-193 provides that the state may establish Reserve Funds. The State Comptroller shall establish within the federal fund accounting for the Department of Social Services a Reserve Fund for the Block Grants for Temporary Assistance for Needy Families. The purpose of such Reserve Fund shall be to meet any unanticipated costs of Public Law 104-193. The Department of Social Services shall request all Public Law 104-193 funds that are available to the Commonwealth of Virginia. The Department of Social Services shall expend funds in accordance with the adopted State Plan and as appropriated within this act, and after meeting all such obligations shall deposit into the Reserve Fund any remaining funds not to exceed $19,336,440 no later than June 30, 1997, and an additional $5,251,499 no later than June 30, 1998. Such funds shall be held to meet any unanticipated costs of Public Law 104-193 and can be released in accordance with §4-1.03 or §4-1.05 b. of this act, provided that upon such action the Director of the Department of Planning and Budget notify the Chairmen of the House Appropriations and Senate Finance Committees. Should the State Comptroller determine that such a Reserve Fund would not be permissible under the Cash Management Improvement Act Agreement Between the Commonwealth of Virginia and the Secretary of the United States Department of the Treasury and Public Law 104-193, he shall immediately advise the Department of Social Services and the Director of the Department of Planning and Budget of his findings. The Director of the Department of Planning and Budget shall act in accordance with §4-1.04. Also, the Department of Social Services shall amend its requests for funding under Public Law 104-193. The State Comptroller, Director of the Department of Planning and Budget, and the Commissioner of Social Services shall provide a report on their actions to the Chairmen of the House Appropriations and Senate Finance Committees.
