Language Page 439, after line 45, insert:"A. There is hereby created the Virginia Tobacco Settlement Trust Fund whose purpose is to receive moneys appropriated by the Commonwealth that are paid under the Cigarette Master Settlement Agreement and Consent Decree.B. The Comptroller shall pay to the Tobacco Settlement Trust Fund all monies received under the consent decree, amounts estimated at $40 million per year in the current biennium, for the purpose of supporting the establishment and administration of a nonprofit public/private foundation, to be established by the General Assembly which will direct a statewide, comprehensive tobacco use prevention and control program for all Virginians to reduce the burden of tobacco-related disease in the Commonwealth, in accordance with the intent of the tobacco settlement. The foundation shall use Center for Disease Control and Prevention guidelines to provide a comprehensive prevention and control program including, but not limited to, community prevention programs, programs to reduce tobacco-related diseases, school programs, enforcement, partnership grants, counter-marketing measures, cessation programs, and surveillance and evaluation activities."
Explanation(This amendment creates a trust fund in which anticipated tobacco settlement agreement funds may be appropriated. Language specifies that the fund will be used to set up a public/private foundation to direct the use of those funds on a comprehensive tobaccos use prevention and control program.)
